By submitting your patch via the webOS-Patches Upload Form, committing it to the Gitorious.org/webos-internals/modifications repository or posting it to the webOS-Internals Wiki, you, the submitter, explicitly agree you are either the original author of the patch or have the right to submit the patch under the MIT Open Source License. Further, by submitting via the above methods you automatically agree the patch will be licensed under the MIT Open Source License. This is to allow Palm to use the patches as-is to incorporate them into future webOS releases. At this time, patches that are not licensed under the MIT Open Source License can not be included for distribution in the webOS-Patches feed which is used by Preware, WebOS Quick Install and PreLoad.

Note that the AutoPatch technology used in the packaging of patches for the webOS-Patches feed is GNU GPL v2 licensed, which means that closed source patch authors cannot use it to produce patches that are compatible with the Emergency Patch Recover tool.

Also note that combining an MIT Open Source License licensed patch with GNU GPL v2 Open Source licensed AutoPatch technology into an ipkg file does not change the MIT licensing of the original patch file (so Palm can still use it as they please), but does ensure the free redistribution of the ipkg file which contains the patch.
